Competition Terms and Conditions
The following terms and conditions apply to 104.7’s promotion “Bike on the Back” competition (the “Competition”).
By submitting an entry in the Competition, persons warrant that they agree to be bound by and have read and understood these terms and conditions.
These terms and conditions can be collected at the 104.7 reception desk at Bellenden Street, Gungahlin and downloaded from the website at www.1047.com.au (the “Website”).
1. DURATION
The promotion will run from Monday 4 August – Friday 29 August, 2008 (the “Competition Period”).
The major prize draw will take place on Friday 29 August, 2008. A second chance unclaimed prize draw will take place on 29 November, 2008 (if the prize is unclaimed at this time).
2. METHODS OF ENTRY
Over a 4 week period, listeners will be encouraged to track down Black Thunder with the motorcycle to be won, displayed on the back. They will fill out an entry form and go into the draw for their chance to win.
There will be 3 live crosses a day at locations all around Canberra and the motorcycle will be displayed on the back for the full 4 week period.
The prize draw will take place on Friday 29 August, 2008, between 3pm & 4pm. This draw will be conducted in the 104.7 studios located on Bellenden Street, Gungahlin, ACT 2912.
Entry is open to Australian Capital Territory residents and residents of NSW within an 80km radius from within the Australian Capital Territory and within the 104.7 broadcast license area.
3. PRIZE(s)
Major Prize:
The Major Prize is a Suzuki GS500F Motorcycle including on road costs.
The total Major Prize value is: $8,740.00.
It is a condition of entry that 104.7 has the right to publicise the names, characters, likenesses or voices of any contestants for any promotion or matter incidental to the competition.
The winner may also be required by 104.7 to participate in a photo, recording, video and/or film session (the “publicity materials”) and acknowledges that 104.7 has the right to use such materials in any medium (including, without limitation, the internet) and in any reasonable manner it sees fit, unless that person advises 104.7 at the time of entering the competition that he/she wishes to retain his/her anonymity.
Contestants also acknowledge that their photo may be used for a promotional display at the prize provider’s location.
Contestants consent to their telephone and other conversations with 104.7 being broadcast on air.
5. INDEMNITY
All contestants release from, and indemnify Canberra FM Radio against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the competition including (but not limited to) loss of income, personal injury and damage to property and whether direct, consequential, foreseeable or due to some negligent act or omission or otherwise.
6. NOTIFICATION
The prize winner will notified on the telephone at the time of winning. Winner’s details will be published on the website www.1047.com.au. The winner will also be notified by mail.
7. COPYRIGHT
By entering this competition all entrants:
· consent to Canberra FM Radio making copies of the whole or any part of their entry;
· grant to Canberra FM Radio all present and future copyright and all other rights in their entry and the publicity materials in all media (including, without limitation, the internet) and whether in existence now or created in the future;
· undertake to Canberra FM Radio that their entry is not in breach of any third party intellectual property rights.
8. PRIZES NON TRANSFERABLE
All prizes are non transferable, non exchangeable, must be used on the dates specified above (where applicable) and are not redeemable for cash unless cash is specified.
If a winner does not take any element of a prize at the time stipulated by 104.7 then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
9. PRIZE COLLECTION
Winners will be required to collect their prize from the 104.7 reception at Bellenden Street, Gungahlin.
10. TAXES
Winners will be responsible for any and all taxes incurred in relation to their receipt of their prize(s). Winners should seek independent financial advice prior to accepting a prize if this is a concern.
11. ELIGIBILITY
Employees and the immediate families of Canberra FM Radio and its related bodies corporate are ineligible to enter. Employees and the immediate families of all associated sponsors and participating companies are also ineligible to enter.
12. TAMPERING
If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile phone failure, tampering, fraud or any other causes beyond the control of Austereo which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, 104.7 reserves the right subject to State regulations to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
13. PRIZE AVAILABILITY
Canberra FM Radio will not be responsible or liable if for any reason beyond their reasonable control any element of any prize is not provided. Canberra FM Radio may, subject to State regulations, substitute a different prize of equivalent value in place of any prize referred to in these terms and conditions.
13. CONDITION OF PRIZE REDEMPTION
All winners of all prizes must sign these terms and conditions in order to receive their prize. In the event that a prize winner under the age of 18 years is permitted to accept a prize, these terms and conditions must be signed by their parent or legal guardian.
15. DECISIONS FINAL
In all matters, all decisions of 104.7 staff will be final and cannot be contested. No correspondence or discussions will be entertained.
16. LEAVE FOR PARTICIPATION
Obtaining time off work and/or study or related activities to participate in this competition will be the sole and absolute responsibility of each contestant.
17. UNCLAIMED PRIZES
An unclaimed prize draw will take place on 29 November, 2008. This draw will be conducted at the 104.7 Studios located on Bellenden Street Gungahlin A.C.T 2912 between 3pm and 4pm.
18. EXCLUSION OF PARTICIPANTS
104.7 reserves the right to exclude any persons from the competition or participating in any prizes on the ground of their medical condition or history or any reason whatsoever.
19. MINORS
The major prize winner must be over the age of 18, if the winner of the major prize is under the age of 18 years, the prize will may at the absolute discretion of 104.7 be awarded to the winner’s parent or legal guardian.
20. TERMINATION OF COMPETITION
104.7 may, subject to State Regulations, terminate this competition at any time at its absolute discretion without liability to any contestant or other person.
21. PERSONAL INFORMATION AND PRIVACY
The personal information supplied by entrants when entering this competition will be used by 104.7 to conduct the contest and to contact entrants if they are a winner. The information may also become part of a database kept by 104.7 used to let entrants know about special offers from 104.7 and new developments. Please refer to our Privacy Policy for more information as entry in this contest is an agreement to be bound by that policy. Our current Privacy Policy is available on the website or from 104.7 reception. All entrants may have their details removed from the database at any time by simply contacting 104.7 on 02 6123 4104 or via the website. If details are removed prior to the conclusion of the competition and/or award of prize(s), entrants will forfeit their right to claim any prizes.
