CANBERRA FM GENERAL TERMS AND CONDITIONS
1. THE PROMOTER
Canberra FM Radio Pty Limited as manager for Canberra FM Radio Pty Limited Joint Venture.
ABN 35 485 579 727.
2. MEANING OF WORDS
The Promoter refers to Canberra FM Radio Pty Limited as manager for Canberra FM Radio Pty Limited Joint Venture.
The Competition refers to on-air and website based competition giveaways.
Conditions of Entry and Competition and Entry Details relate to those outlined on the 104.7 and MIX106.3 websites and detailed in these Terms and Conditions.
3. THE COMPETITION
(a) The competitions are run on the air and/or via the websites www.1047.com.au or www.mix106.com.au by the Promoter.
(b) Subject to the Terms and Conditions a eligible person may enter the competition for the chance to win prizes offered by the Promoter.
4. WHO MAY ENTER
(a) The competition is open to residents of the Australian Capital Territory and those residents of New South Wales residing within 80 kilometers of the Central Business District of Canberra. Some individual prizes may carry age restrictions which will be publicised.
(b) The competition is not open to: (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition; or
(c) The spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether or not they live in the same household).
5. DURATION
The promotions will run from Sunday 16th August 2009 – Monday 15th August 2010
6. METHOD OF ENTRY
The Promoter will allow the following methods of entry:
(a) Text/SMS – 1990 1047. The cost will be limited to 55c ($0.55)

7. GENERAL PRIZES
(a) Prizes are non-transferable and may not be redeemed for cash. If the specified prize becomes unavailable due to unforeseen circumstances, the Promoter may substitute a prize of a like or equal value.
(b) Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of that winner.
(c) The drawing or judging of each prize will take place on a date and time of the Promoters choice. It is at the Promoters discretion to announce that a draw or judging for a particular prize will take place.
(d) Prizes will consist mainly of CD’s, DVD’s, Movie Tickets and concert tickets.
(e) No prize will be valued over $1,000.00.
(f) The major prize winner will be notified by telephone. An Unclaimed Prize draw will take place no sooner than 3 months from the original draw date. The draws will take at the studios on Bellenden Street Gungahlin A.C.T 2912.
(g) There will be 52 lotteries on both stations, MIX 106.3 & 104.7 across the time period. (104 in total)
8. NOTIFICATION OF WINNERS / PRIZE COLLECTION
(a) All winning participants will be contacted by an authorised representative of the Promoter who will advise when the prize is ready for collection. All winning participants will be notified via email, telephone, post or fax.
(b) Prizes must be claimed in person from the Promoter unless winner is otherwise advised. Proof of identification will be required to be provided to the Promoter in order to claim any prizes. Identification required will need to include:
(c) Photo; and
(d) Current residential address
(e) Upon request by the Promoter a copy of the general contest rules and/or signed receipt and acknowledgement must be signed and endorsed by any winner to indicate their understanding and acceptance of these terms.
(f) Prizes will only be awarded following winner validation and verification.
(g) The judge’s decision is final and no correspondence will be entered into.
9. PUBLICITY
Entry into the competition constitutes permission for the Promoter to use a winner’s name, suburb of residence, recording of winners’ voice and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law.
10. EXCLUSION OF LIABILITY
(a) The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise delivery or contact details provided by an entrant.
(b) The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes.
(c) The Promoter is not responsible for losses associated with any changes to the value of any prizes.
(d) To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property and including, but not limited to consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner(s) and, where applicable, to any persons accompanying the winners.
(e) A winner (or their guests/parent/guardian as appropriate) may be required to sign and return any liability release by the Promoter and/or its contractors as a condition of the prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and a selection of another winner.
11. DISQUALIFICATION / DISCONTINUATION OF PROMOTION
(a) The Promoter reserves the right to discontinue the Competition at any time, including the termination of all opportunities to use or otherwise redeem accumulated Points, without loss to the Promoter or any other partners involved in the Competition.
(b) Subject to any written directions given under the applicable law, if for any reason, the Competition is not capable of operating as planned then the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this competition.
(c) The Promoter reserves the right, in its sole discretion, to disqualify any individual for:
(d) Tampering with the entry process, including exceeding any limitation on the number of Member Accounts, or any other process as determined by the Promoter that in any way affects the fairness of the Promotion;
(e) Acting in violation of these terms and conditions; or
(f) If an entrant selected as a winner is found to be in breach of any section of the terms and conditions, a new winner may be selected and, in the event that the entrant in breach has been awarded a prize, the entrant may be required to return the prize or reimburse the value of the prize to the Promoter.
12. PARTICIPATION
(a) Participation in the competition constitutes the entrants unconditional agreement to and acceptance of these Conditions of Entry and Competition and Entry Details. The terms and conditions may change from time to time. The Member is responsible for insuring their familiarity with the Terms and Conditions at the time of participation. The promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the Conditions of Entry generally.

13. PRIVACY

14. UNCLAIMED PRIZES
Should the winner not claim the prize, or the promoter be unable to locate the winner, an unclaimed prize draw will be held 3 months after the initial draw.

CANBERRA FM CREATIVE TERMS AND CONDITIONS
The following terms apply (in addition to Canberra FM’s terms and conditions) to any advertiser who requests that Canberra FM Pty Limited ABN 35 485 579 727 or its subsidiaries (ARN) provide advertising, creative or production services (Advertiser).
1. OWNERSHIP
(a) All intellectual property rights (including but not limited to copyright) in any advertisements, advertising copy, advertising script, advertising, creative proposals, sound broadcast, recording or any other document, work or material (Material) produced or written for the Advertiser by Canberra FM or its employees or agents vests entirely in Canberra FM.
(b) Prior written clearance of the Director of Sales will be required for any use of any Material otherwise than on Canberra FM radio stations. Permission may be withheld.
(c) Advertiser will keep confidential any Material (directly or indirectly) supplied to Advertiser and will not, without written clearance from the Director of Sales, use or exploit such Material except for the advertising and promotional campaign placed with Canberra FM.
2. ADVERTISING MATERIAL
Advertiser will ensure that all advertising material submitted to Canberra FM by or on behalf of Advertiser, or Material expressly or impliedly approved by Advertiser, shall comply with any particular laws, regulations and advertising and broadcasting codes or standards as are in place from time to time and without limiting the generality of this clause will not contain any defamatory material or material in breach of the Trade Practices Act 1974 (Cth).
3. INDEMNITY
Advertiser will indemnify and keep indemnified Canberra FM, its related bodies corporate and each of their respective officers, employees and agents against all claims, demands, proceedings, damages, costs, expenses, losses or any other liability whatsoever arising wholly or partly, directly or indirectly in connection with the broadcast of any advertising material submitted by or on behalf of Advertiser, or Material expressly or impliedly approved by the Advertiser, including but not limited to any breach of any law or regulation or for any breach of any legal, equitable or other rights of any person, firm, corporation or entity.
